The processing of personal data is governed primarily by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), which you may know as the GDPR.
2. What is personal data, and for what purpose do you provide it to us?
Personal data refers to the identifiers of a natural person that you have provided to us, specifically: first name, surname, email address, IP address, telephone number, postal address (where applicable) and company registration number.
You provide us with your personal data for the purpose of taking steps to conclude a contract for work or for the provision of services to you, our customers. The work or service provided may consist of consultancy, the performance of work or the supply of goods. We may use the data for the purposes of contacting you, processing contracts, fulfilling contracts and for electronic forms of direct marketing (in particular for sending commercial communications and newsletters) in accordance with Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no order for goods or services has been placed.
3. How long we retain your personal data
Your personal data is processed for the period necessary to fulfil the rights and obligations arising from the contractual relationship between you and us, or between you and our contractors. We will process your data for 10 years following the termination of our contractual relationship.
If we process your personal data solely on the basis of your consent, we will retain it for a maximum of 1 month, after which it will be deleted. However, you may withdraw your consent to the processing of your personal data at any time prior to this, in which case we are obliged to delete your personal data without delay.
4. Recipients and processors of personal data
We, as the data controller, process personal data. Personal data is also processed on our behalf by our contractual or statutory partners who are involved in the supply of goods and services („Processors“). Processors may include companies providing health and safety solutions, regional distribution companies, transport companies and the postal service, as well as individuals responsible for the operation of our website and related services.
Our contractual partners are not permitted to pass on your personal data to third parties unless this is necessary for the provision of a service or the performance of a contract.
We do not profile your personal data, nor do we transfer it outside the European Union, with the exception of your IP address. When cookies are used, your IP address may be made available outside the EU (to the USA) when processed via Google Analytics, subject to your consent.
5. Your rights
The GDPR gives you a whole host of rights:
- the right of access to your personal data under Article 15 of the GDPR,
- the right to have personal data rectified in accordance with Article 16 of the GDPR, or to have processing restricted in accordance with Article 18 of the GDPR.
- the right to erasure of personal data under Article 17 of the GDPR.
- the right to object to processing pursuant to Article 21 of the GDPR and
- the right to data portability under Article 20 of the GDPR.
- the right to withdraw consent to processing in writing or electronically to the address or email address of the data controller specified in Article III of these terms and conditions.
You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been infringed.
6. Conditions for the protection of personal data
Smotech s.r.o., as the data controller, declares that it has taken all appropriate technical and organisational measures to safeguard personal data.
We further declare that only persons authorised by us have access to personal data.
